Welcome to the official Terms and Conditions document of ALI HAMAD | ZEERODIGITAL. By accessing, browsing, viewing, interacting with, submitting information to, or otherwise utilizing any features, pages, embedded tools, APIs, plug-ins, consultation sessions, or communication systems associated with our websites, business portals, email infrastructure, text messaging campaigns, marketing strategies, or digital platforms — including, but in no way limited to, the engagement in our SMS messaging program — you, the user, hereby acknowledge, represent, and warrant that you have thoroughly read, completely understood, and voluntarily agreed to be legally bound by the full scope of the Terms and Conditions as detailed below. These Terms of Use, sometimes referred to herein as the "Terms," constitute a full and binding legal agreement between you and ALI HAMAD | ZEERODIGITAL. These Terms apply to and govern all users of our services and products, which may include, but are not limited to, casual or incidental website visitors, subscribers to email newsletters, parties participating in trials or beta programs, third-party affiliates, software vendors, contractual marketing clients, licensed users, platform testers, strategic business collaborators, employees, and service providers.

Any and all continued engagement or participation in our platforms, services, communications, digital products, or business relationships — regardless of intent — shall serve as conclusive and binding evidence that you have willingly consented to and accepted each of the Terms and Conditions enumerated herein, without limitation, exception, or qualification.

SMS/Messaging Program(s) Terms And Conditions

1. Upon opting in you will join ALI HAMAD | ZEERODIGITAL messaging program that involves the occasional marketing tips as well as promotions or news related to ALI HAMAD | ZEERODIGITAL and its operations.
2. You can cancel the SMS service at any time. Simply text "STOP" to +1(513) 679-5054. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.
3. If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to (support email address or toll-free number).
4.Carriers are not liable for delayed or undelivered messages.

Legal Interpretations and Enforceability

This document is to be interpreted in its broadest possible scope to ensure full enforceability under applicable laws and regulations. Any ambiguities or potential conflicts in interpretation shall not be construed against the drafting party — namely, ALI HAMAD | ZEERODIGITAL — but rather shall be interpreted in accordance with the plain language and overarching intent of protecting the legitimate business interests, intellectual property, operational integrity, client relationships, and reputation of ALI HAMAD | ZEERODIGITAL.

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, unlawful, void, or otherwise unenforceable for any reason, the remainder of the Terms shall continue in full force and effect as if such provision had never been included. No waiver of any provision or breach shall constitute a waiver of any other or subsequent breach. All remedies provided herein or otherwise available shall be cumulative and not exclusive of any other rights or remedies under law or equity.

General Acknowledgment of Risks

By engaging with ALI HAMAD | ZEERODIGITAL, you expressly acknowledge that digital services inherently involve a certain degree of unpredictability, risk, and subjectivity. This includes but is not limited to exposure to marketing fluctuations, third-party service outages, technical bugs, delayed results, compliance shifts, platform policy changes (e.g., Meta, Google Ads, LinkedIn), changes to algorithmic rankings, and client-specific challenges such as lack of internal follow-up, product-market misalignment, or reputational damage beyond the control of ALI HAMAD | ZEERODIGITAL.

You acknowledge that while ALI HAMAD | ZEERODIGITAL takes reasonable steps to prevent disruption and optimize service delivery, certain outcomes are outside of our control, and that no statements, written or verbal, shall be construed as guarantees unless explicitly stated in writing as a legally binding performance clause.

Dispute Resolution and Arbitration

In the event of a disagreement, controversy, dispute, claim, or alleged breach arising out of or related to this Agreement, the parties agree to engage in good faith negotiations to resolve the matter informally and amicably. If a resolution cannot be reached through direct negotiations within thirty (30) days, the parties agree to submit the matter to binding arbitration.

The arbitration shall be conducted in accordance with the Commercial Arbitration Rules of the American Arbitration Association (AAA) in effect at the time the arbitration is initiated. The arbitration shall take place in Polk County, Iowa, unless another location is agreed upon in writing by both parties. The language of the arbitration shall be English. The award rendered by the arbitrator shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Each party shall be responsible for its own costs and expenses, including attorney’s fees, unless otherwise determined by the arbitrator.

Compliance With Laws

You agree to comply fully with all domestic and international laws, statutes, ordinances, and regulations that apply to your use of the services provided by ALI HAMAD | ZEERODIGITAL. This includes compliance with laws related to privacy, electronic communications, intellectual property, defamation, harassment, unfair competition, and consumer protection.

Clients must not use services provided by ALI HAMAD | ZEERODIGITAL for any unlawful purpose or in any manner that could give rise to civil or criminal liability. Failure to adhere to legal obligations may result in immediate suspension of services and notification to law enforcement or regulatory authorities.

Reservation of Rights

ALI HAMAD | ZEERODIGITAL explicitly reserves all rights not expressly granted in these Terms. Nothing in these Terms shall be construed as limiting any legal rights ALI HAMAD | ZEERODIGITAL may have under any applicable law, statute, regulation, or guideline.

We reserve the right to refuse service, terminate accounts, remove or edit content, and cancel projects at our sole discretion. In such cases, any prepaid services not rendered may be refunded at the discretion of ALI HAMAD | ZEERODIGITAL.

Our DBA

For branding purposes, marketing materials, communication shorthand, and client-facing correspondence, ALI HAMAD | ZEERODIGITAL may operate under the simplified trade name or alias "ZeeroDigital" or "ZEERODIGITAL." This designation serves as a commonly recognized, more succinct version of the full legal entity name and may appear on invoices, business cards, social media handles, promotional content, email signatures, service contracts, appointment confirmations, newsletters, and other forms of communication and documentation.

It should be clearly understood that regardless of the usage of the simplified DBA (Doing Business As) name "ZeeroDigital" or its stylistic variations, all obligations, representations, warranties, contracts, legal claims, and rights ultimately pertain to and are enforceable against the full and complete legal entity known as ALI HAMAD | ZEERODIGITAL. Any and all references to ZeeroDigital or ZEERODIGITAL in the context of business transactions, service delivery, legal documentation, or customer engagement shall be considered equivalent to referring directly to ALI HAMAD | ZEERODIGITAL in its full legal capacity.

This use of a DBA is solely intended to facilitate ease of brand recognition, improve communication clarity, and streamline operational language for clients, partners, and other relevant stakeholders. It does not indicate the creation of a separate corporate entity nor does it alter the legal obligations of ALI HAMAD | ZEERODIGITAL in any jurisdiction.

Any notices or communications required or permitted under these Terms must be in writing and shall be deemed delivered upon receipt by personal delivery, certified mail (return receipt requested), or email to the addresses specified in the Contact section.
